Terms and Conditions
These Terms & Conditions apply to all services provided by McDaniel Marketing & Media LLC unless otherwise agreed to in writing.
Scope of Work
Services will be performed as outlined in the associated quote or proposal. Any services requested outside the defined scope may require an additional quote and approval prior to work beginning.
Payment Terms
Payment terms are specified within the quote or invoice. Unless otherwise stated, payments are required within 15 days of the start of work.
Revisions
Services include a standard revision period of 2 weeks that includes a reasonable number of revisions related to the original scope of work. Additional revisions or major changes requested by the client may incur additional fees at the discretion of McDaniel Marketing & Media LLC.
Client Responsibilities
The client agrees to provide necessary materials, approvals, and feedback in a timely manner. Delays in providing required information may impact project timelines.
Project Timeline
Estimated timelines are provided for planning purposes. Actual completion times may vary based on project complexity, client feedback speed, and unforeseen circumstances.
Intellectual Property
Upon full payment, the client will receive the rights to the final approved deliverables produced under the agreed scope of work. McDaniel Marketing & Media LLC retains the right to display completed work in portfolios, marketing materials, and case studies unless otherwise agreed.
Third-Party Costs
Certain services may involve third-party expenses such as advertising, software subscriptions, hosting platforms, etc. These costs are not included unless explicitly stated in the quote/invoice. The client is responsible for providing a payment method should 3rd party costs be required to complete the service.
Listing Photography Services
Listing photography services provided by McDaniel Marketing & Media LLC must be quoted and billed individually unless otherwise stated in writing.
Photography services are limited to the specific property and deliverables outlined in the associated quote or invoice. Any additional services requested, including but not limited to additional photos, drone photography, video, twilight photography, or additional editing, may require an additional quote and approval prior to completion.
The client is responsible for ensuring that the property is clean, staged, and ready for photography at the scheduled appointment time. McDaniel Marketing & Media LLC is not responsible for delays caused by property readiness.
If the property is not ready at the scheduled time, McDaniel Marketing & Media LLC reserves the right to reschedule the appointment or charge a rescheduling fee.
Listing photography appointments may be rescheduled with at least 24 hours' notice. Cancellations or rescheduling requests made with less than 24 hours' notice may be subject to a cancellation fee.
Unless otherwise agreed in writing, payment for listing photography services is due upon delivery of the final media files.
Upon full payment, the client will receive the right to use the delivered media for marketing the specific property associated with the shoot. McDaniel Marketing & Media LLC retains the right to use the images and media for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
Media produced for a listing may not be reused for marketing other properties, listings, or businesses without written permission from McDaniel Marketing & Media LLC.
Monthly-Based Services
Certain services offered by McDaniel Marketing & Media LLC are provided as a monthly service package that includes a set number of service hours for digital marketing, photography, videography, and related services.
The service period will begin on the date specified in the associated quote and will end 30 days from that date, unless otherwise stated in writing.
The client will receive the total number of service hours specified in the quote for the service period. These hours may be used for services included within the agreed scope of work. Unused hours do not roll over to future service periods, and no refunds will be issued for unused hours.
If the client requires services beyond the hours included in the monthly package, additional time may be billed at a rate of $30 per additional hour, unless otherwise agreed in writing.
McDaniel Marketing & Media LLC will not exceed the hours included without prior approval from the client. If the included hours are reached during the service period, the client will be notified before any additional billable work is performed.
Listing photography services are not included in monthly service packages and must be quoted and billed separately unless explicitly stated otherwise in writing.
Cancellation/Refund Policy
All payments made to McDaniel Marketing & Media LLC are non-refundable once work has begun or services have been purchased, as time and resources are allocated immediately upon project acceptance.
If McDaniel Marketing & Media LLC is unable to complete the agreed services due to any circumstances, the client will be eligible to receive a full refund of any payments made for the uncompleted services.
If only a portion of the work has been completed prior to such circumstances, McDaniel Marketing & Media LLC may issue a partial refund for the portion of work that was not completed.
Projects may be cancelled by McDaniel Marketing & Media, LLC at any time for any reason. The client will be responsible for payment of all work completed up to the cancellation date.
Limitation of Liability
McDaniel Marketing & Media LLC shall not be liable for indirect or consequential damages arising from the use of services provided. Marketing results may vary and cannot be guaranteed.
Acceptance of Terms
Approval of a quote, payment of an invoice, or written authorization to proceed constitutes acceptance of these Terms & Conditions.
